This Terms and Conditions Agreement ("Agreement") constitutes a legally binding contract between NetWealth LLC, doing business as LandCentury.com ("LandCentury," "Company," "We," "Our," or "Us"), and you ("User," "You," or "Your"), governing your access to and use of LandCentury.com, Globally.Land, LandBe.com, and all affiliated platforms, applications, and services (collectively, the "Platform").
By accessing, registering for, or otherwise using the Platform, You acknowledge that You have read, understood, and agree to be bound by this Agreement. If You do not agree, You must immediately discontinue use of the Platform.
1. Eligibility and Account Registration
1.1 Eligibility.
You must be at least eighteen (18) years of age and legally capable of entering into binding contracts to use the Platform. By using the Platform, You represent and warrant that You meet these requirements.
1.2 Account Security.
You are responsible for maintaining the confidentiality of Your account credentials and all activity conducted under Your account. LandCentury shall not be liable for any loss or damage arising from Your failure to secure Your account.
2. Role of the Platform
2.1 Third-Party Marketplace.
LandCentury is a third-party online marketing and listing platform that connects property sellers with prospective buyers. LandCentury is not a real estate broker, agent, fiduciary, escrow holder, or financial institution and does not represent buyers or sellers in any capacity.
2.2 No Representation or Guarantee.
LandCentury does not verify, warrant, or guarantee:
- The accuracy, legality, or completeness of any listing;
- The condition, title, or availability of any property;
- The identity, integrity, or performance of any User;
- The success of any transaction, lead, or sale.
All transactions are conducted directly between Users, and LandCentury has no involvement in negotiations, contracts, or property transfers.
3. User Obligations
3.1 Accurate Information.
You shall provide accurate, current, and lawful information in all listings, communications, and transactions.
3.2 Compliance with Laws.
You are solely responsible for ensuring that Your use of the Platform and listings complies with all applicable local, state, federal, and international laws, including real estate advertising and fair housing regulations.
3.3 Prohibited Conduct.
Users shall not:
- Post false, misleading, or fraudulent listings;
- Circumvent LandCentury's lead-generation or payment system, including by placing external contact information in property descriptions;
- Upload or transmit spam, malware, or harmful code;
- Harass, threaten, or abuse any User or staff;
- Scrape, mine, or otherwise extract data from the Platform without prior written authorization;
- Post contact details, links, or instructions that encourage communication outside the Platform to avoid fees.
4. Fees, Payments, and Refunds
4.1 Payment Models.
LandCentury may offer Pay-Per-Performance ("PPL"), subscription, single-listing, custom, or transaction-based plans. All fees are due in accordance with the selected plan or service and must be paid before activation of listings or services.
4.2 Account Balance.
Users must maintain a positive account balance for listings to remain active. If an account balance reaches $0, listings may be removed, suspended, or placed in draft status until replenishment.
4.3 Processing and Reservation Fees.
LandCentury may offer a "Buy Now," "Reserve Property," or similar feature allowing a buyer to make a processing or reservation payment through the Platform.
- This payment is a non-refundable processing fee paid directly to LandCentury, not to the seller.
- The processing fee does not constitute a deposit, down payment, or partial payment toward the purchase of property.
- The fee represents compensation to LandCentury for facilitating the reservation or handling the transaction request and does not guarantee property transfer or exclusivity.
- LandCentury shall remit or allocate any portion of funds in accordance with its internal policies and agreements with sellers, minus applicable service or processing charges.
- Buyers and sellers are solely responsible for entering into and performing any purchase, sale, or escrow agreements directly with one another.
- LandCentury reserves the right to withhold, refund, or retain processing payments, in whole or in part, in cases of suspected fraud, chargeback, dispute, or policy violation.
4.4 Non-Refundable Payments.
All payments made to LandCentury, including but not limited to subscription fees, listing fees, PPL fees, lead purchases, and processing or reservation fees, are final and non-refundable once processed, except as required by law. By using the Platform, You expressly acknowledge that You will not be entitled to any refund or credit after payment submission.
4.5 Fee Modifications.
LandCentury reserves the right to adjust pricing, billing, or service fees at any time with reasonable notice via the Platform or email.
5. Suspension and Termination
LandCentury reserves the right, at its sole discretion and without notice, to suspend, restrict, or terminate any account or access to the Platform for:
- Violation of this Agreement or Platform policies;
- Suspected fraud, abuse, or illegal activity;
- Attempts to bypass payment systems or communicate off-platform;
- Posting prohibited or deceptive content.
Upon termination, all rights granted herein immediately cease. Any funds remaining in Your account may be forfeited unless required otherwise by law.
6. Intellectual Property
All Platform content, including software, text, design, trademarks, and graphics, is owned or licensed by LandCentury and protected by intellectual property laws.
By submitting listings, property descriptions, images, or other content, You grant LandCentury a worldwide, perpetual, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, distribute, and promote such content for the operation and marketing of the Platform.
7. Copyright (DMCA) Compliance
LandCentury respects intellectual property rights. Pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512), LandCentury designates the following agent for copyright notices:

LandCentury may remove infringing content and terminate repeat infringers.
8. Privacy and Data Use
8.1 Privacy Policy.
Use of the Platform is also governed by our Privacy Policy, which is incorporated herein by reference.
8.2 Lead Data Ownership and Use.
All lead and contact data generated through the Platform are the property of LandCentury.
8.3 Resale and Distribution of Data.
By agreeing to this Agreement, You grant LandCentury the right to collect, store, use, and resell or share contact and lead information generated through Your listings or account activity with verified partners, advertisers, or sellers for marketing or commercial purposes.
8.4 User Restrictions.
Users may use leads obtained through the Platform only for their own legitimate business purposes and may not resell, redistribute, or misuse such data.
9. Indemnification
You agree to indemnify, defend, and hold harmless LandCentury, its affiliates, officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, or expenses (including attorneys' fees) arising from:
- Your use of the Platform or content;
- Your listings or transactions;
- Any breach of this Agreement;
- Any dispute between You and another User;
- LandCentury's resale or redistribution of contact or lead data as authorized herein.
10. Disclaimer of Warranties and Limitation of Liability
10.1 Disclaimer.
THE PLATFORM, INCLUDING ANY "BUY NOW" OR "RESERVE PROPERTY" FEATURE, IS PROVIDED "AS IS" AND "AS AVAILABLE."
LANDCENTURY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
LANDCENTURY DOES NOT WARRANT OR GUARANTEE:
- THE ACCURACY OR LEGALITY OF ANY LISTING;
- THAT A BUYER OR SELLER WILL COMPLETE A TRANSACTION;
- THAT ANY PROPERTY IS FREE OF DEFECTS OR ENCUMBRANCES;
- THAT ANY PAYMENT OR PROCESSING FEE WILL RESULT IN A SALE OR PROPERTY TRANSFER.
LANDCENTURY IS A THIRD-PARTY TECHNOLOGY PLATFORM AND PAYMENT FACILITATOR ONLY. IT DOES NOT PARTICIPATE IN OR VALIDATE ANY PROPERTY TRANSACTION AND IS NOT LIABLE FOR ANY ACTIONS OR OMISSIONS OF USERS.
10.2 Limitation of Liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANDCENTURY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, FUNDS, DATA, OR GOODWILL ARISING OUT OF OR RELATING TO USE OF THE PLATFORM, LISTINGS, OR TRANSACTIONS.
IN NO EVENT SHALL LANDCENTURY'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF FEES PAID TO LANDCENTURY IN THE SIX (6) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising under this Agreement shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules.
Users waive any right to participate in class actions or representative proceedings against LandCentury.
12. Miscellaneous
12.1 Severability.
If any provision of this Agreement is found unenforceable, the remainder remains in effect.
12.2 Entire Agreement.
This Agreement, together with the Privacy Policy, constitutes the entire understanding between You and LandCentury.
12.3 Survival.
Sections relating to intellectual property, data use, indemnification, payments, and limitation of liability shall survive termination.
12.4 Modifications.
LandCentury may amend or update these Terms at any time. Continued use after updates constitutes acceptance.
